Part 1: Terms of Service & End User License Agreement (ToS & EULA)

Welcome to GoTraveli! These Terms of Service (hereinafter "Terms" or "ToS") constitute a legally binding end-user license agreement between you and GoTraveli LLC (registered in Wyoming, USA, with offices at 1021 E Lincolnway Suite #10071, Cheyenne, WY 82001, USA, hereinafter "we," "us," or the "Company") regarding your access to and use of the GoTraveli website (https://gotraveli.com), mobile applications, and related services (collectively, the "Service").
⚠️ CRITICAL LEGAL NOTICE (BINDING ARBITRATION AND CLASS ACTION WAIVER): Please read Section 12 carefully. These Terms contain a mandatory Binding Arbitration clause and a Class Action Waiver. This means that, with very limited exceptions, you agree to resolve any disputes with us through individual arbitration, and you expressly waive your right to a trial by a judge or jury in court, as well as your right to participate in any class action or representative proceeding.
By registering an account, clicking "Agree," or actively using the Service, you acknowledge that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Service.
1. Service Description & Availability
- Service Content: GoTraveli provides a SaaS-based intelligent travel planning tool, including manual itinerary creation, AI-powered smart conversational recommendations based on third-party computing models, map route visualization, and facility search.
- Provided "AS IS": The Service is provided on an "AS IS" and "AS AVAILABLE" basis. While we strive to provide a high-quality experience, we do not warrant that the Service will be entirely uninterrupted, secure, or error-free. We reserve the right to modify, suspend, or terminate all or part of the Service at any time without prior notice due to system maintenance, upgrades, or third-party API failures.
2. Account Registration, Security, and Termination Rights
- Passwordless Authentication: We utilize a One-Time Password (OTP) mechanism. You are responsible for maintaining the confidentiality of the email address receiving the OTP. Any action taken through your account is deemed your own action. You bear 100% full responsibility for all activities that occur under your account.
- Age Restrictions: In strict compliance with regulations such as COPPA, this Service is not intended for minors under 13 years of age (or under 16 in certain EEA countries). If you are under the applicable legal age, please immediately cease using the Service and delete your account.
- Single Device Limit & Anti-Abuse: Sharing a single Pro account across multiple devices is strictly prohibited. We reserve the right to monitor abnormal logins and force logouts at any time.
- Our Termination Rights & Tiered Restrictions: To maintain the security and stability of our platform ecosystem, if we reasonably determine that you have violated these Terms (specifically by abusing API limits, engaging in fraud, or violating our Acceptable Use Policy), we reserve the right to implement tiered restriction measures. This may include (but is not limited to) issuing warnings, temporarily restricting your access to specific premium features (such as third-party maps or AI interfaces), or permanently banning your account in cases of severe violations. We commit that any ban decision will be based on our internal security audit logs and objective technical evidence, and we reserve the right to report severe illegal activities to law enforcement agencies in your jurisdiction.
3. Core Service Features & Specific Disclaimers
The Service provides features such as itinerary planning, expense tracking, packing lists, and itinerary sharing. You expressly agree that:
- Itinerary Sharing & Social Risks: When you generate and send an "Itinerary Sharing Link" to others, you solely bear any privacy exposure or real-world security risks resulting from disclosing your travel trajectory. We are not responsible for how third parties use your shared links.
- Expense Tracking & Financial Disclaimer: The in-app "Expense" feature is strictly a personal memo tool and does not constitute any financial, tax, or accounting advice. We bear no responsibility for any currency exchange rate discrepancies, calculation errors, or resulting financial disputes.
4. Experimental AI Services & "Hallucination" Shield
The itinerary planning features provided by GoTraveli are based on generative artificial intelligence technology. Users acknowledge and agree:
- Non-Factual Output: AI-generated recommendations (including but not limited to routes, location statuses, and safety advice) are probabilistic predictive outputs of computer algorithms and are not factual statements, professional consulting, or on-the-ground guides.
- Absolute Verification Duty: Users bear a complete, independent, and exclusive duty to verify AI recommendations before engaging in any actual travel activities (especially regarding safety, visas, operating hours, or transportation).
- Damage Waiver: Given the inherent risk of AI "hallucinations," GoTraveli assumes no legal liability for any direct or indirect losses (including missed flights, travel delays, or personal injury) resulting from reliance on incorrect AI information.
- Third-Party AI Processing: GoTraveli integrates industry-leading third-party generative AI service providers to offer smart itinerary recommendations. When you use AI features, your inputs (Prompts) will be securely transmitted to these third-party providers for processing. You understand and agree that these third parties may process, store, or use this data to optimize their services in accordance with their respective independent privacy policies and terms.
- ⚠️ Ban on Sensitive Data Input: You must not (and are strictly prohibited from) entering any sensitive personal data into the AI interface, including but not limited to medical/health information, financial accounts, government identification numbers, or precise residential addresses. You bear full responsibility for any data breach resulting from your proactive input of such information.
5. Third-Party Dependencies, Map Navigation & Force Majeure Firewall
The high availability of this Service depends on external vendors (including but not limited to OpenAI, Claude, Supabase, Mapbox, Amap, OpenStreetMap, Stripe, etc.).
- Downstream Liability Block: If GoTraveli is unable to provide the Service normally due to technical failures, API adjustments, service interruptions, legal restrictions, or the bankruptcy of such third parties, it shall be deemed a Force Majeure event. We are exempt from liability for service degradation caused by such third parties.
- Map & Real-World Navigation Disclaimer: Our maps and distance calculations rely on third-party data sources. This data is for reference only and cannot replace on-site observation. We make no guarantees regarding the safety of routes, road conditions, road closures, or the actual existence of nearby facilities. You are solely responsible for your personal and property safety during your travels, and you must comply with real-world traffic laws.
6. User-Generated Content (UGC) & Safe Harbor Statement
GoTraveli operates solely as a technology-neutral platform tool.
- Service Ownership: GoTraveli and its underlying code, UI design, and trademarks are the exclusive property of GoTraveli LLC.
- Content License: You retain ownership of the itineraries you create and the photos you upload. You grant us a worldwide, non-exclusive, royalty-free license to store, transmit, and display this content. We expressly state that images you upload are stored solely within your personal account and will never be used for public commercial advertising.
- No Pre-Screening Obligation: We assume no obligation to pre-screen itineraries, reviews, or photos shared by users. Users bear full legal responsibility for any content they post.
- Zero-Tolerance Policy & Enforcement: In strict compliance with major app store requirements (such as the Apple EULA), we enforce a "Zero-Tolerance Policy" against illegal, obscene, hate speech, or content that infringes upon third-party privacy and intellectual property rights. Upon discovery or receipt of a valid report, GoTraveli reserves the right to immediately remove the violating content and restrict or permanently ban the violating account. To prevent malicious abuse and respond to potential legal or payment disputes (e.g., Chargeback investigations), we reserve the right to retain relevant violation audit logs and electronic evidence to the maximum extent permitted by applicable law.
7. Acceptable Use Policy (AUP) & Fair Use Policy (FUP)
You agree not to engage in any of the following activities while using the Service:
- Conducting large-scale automated data scraping on the Service or AI interfaces;
- Attempting to reverse engineer, decompile, or crack AI generation logic and underlying code;
- Using the App to plan, assist, or encourage any illegal activities that violate local laws (e.g., border crossing, illegal assembly);
- Maliciously exhausting API quotas or infringing upon the intellectual property and privacy rights of third parties.
Fair Use Policy (FUP): Although we offer feature privileges marked as "Unlimited" (such as itinerary creation, photo uploads, AI recommendations, etc.) in certain premium subscription plans (Pro), all such features are strictly subject to this Fair Use Policy. "Unlimited" strictly refers to satisfying normal, reasonable personal travel planning needs. If we reasonably determine that your account exhibits abnormally high-frequency usage patterns, automated script operations, or resource consumption that severely exceeds the limits of normal human behavior and potentially impacts the service quality for other users, we reserve the right to implement invisible Rate Limiting, suspend services, or permanently ban your account without prior notice and without refund.
8. Subscriptions, Payments & Refund Policy
- Pro Subscription Services: We offer monthly, annual, and one-time lifetime purchase premium features.
- Auto-Renewing Subscriptions: Unless you cancel at least 24 hours before the end of the current billing cycle, monthly/annual subscriptions will automatically renew. For subscriptions purchased through the Apple App Store, the following mandatory rules apply: Payment will be charged to your Apple ID account at the confirmation of purchase. Subscription automatically renews unless it is canceled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel your subscriptions by going to your account settings on the App Store after purchase.
- Refund Rules:
- Web Platform: For subscriptions processed via Stripe, we generally do not provide pro-rata refunds, except where mandated by law. Upon cancellation, your benefits will remain active until the end of the current billing cycle.
- App Platform: Subscriptions purchased via the Apple App Store or Google Play are subject to the official refund policies of those platforms and must be requested directly from Apple or Google.
9. Data Re-identification Waiver
Users authorize GoTraveli to de-identify their itinerary data and compile it into an anonymous, aggregated database for product optimization and business analysis.
- Risk Acknowledgment: Users acknowledge that, given the advancement of de-anonymization technologies, a theoretical "re-identification" risk may exist. Users agree to waive any claims for liability regarding such privacy risks arising from technological advancements, provided they do not result from our willful misconduct.
10. Accessibility Statement & ADA Compliance
GoTraveli is committed to providing an accessible digital experience. If you encounter any barriers while using our service, please contact us at hello@gotraveli.com. This statement reflects our good faith commitment to compliance and should not be construed as an absolute legal guarantee of specific accessibility standards (such as the US ADA).
11. Limitation of Liability & Indemnification
- Comprehensive Disclaimer: To the maximum extent permitted by applicable law, GoTraveli LLC, its officers, employees, or partners, shall not be liable for any indirect, punitive, incidental, special, or consequential damages (including loss of profits, data loss, travel delays, or personal injury) arising from your use of the Service.
- Liability Cap: To the maximum extent permitted by law, GoTraveli's total cumulative liability to any user (whether in contract or tort) shall in all cases be strictly limited to the greater of: the total fees actually paid by you to us in the twelve (12) months immediately preceding the event giving rise to the claim, or fifty US dollars ($50.00).
- Indemnification: You agree to defend, indemnify, and hold harmless GoTraveli LLC from any claims and substantial attorney's fees arising from: (1) your use or misuse of the Service; (2) your violation of these Terms; or (3) your infringement of any third-party rights.
12. Binding Arbitration & Class Action Waiver
This section applies to the maximum extent permitted by law:
- Governing Law: This Agreement is governed by the laws of the State of Wyoming, USA, excluding its conflict of law principles.
- Individual Arbitration: Any dispute arising out of or relating to the Service shall be submitted to the American Arbitration Association (AAA) for individual arbitration. The arbitration shall take place in Wyoming.
- Class Action Waiver: To the maximum extent permitted by law, you expressly waive your right to participate as a plaintiff or class member in any purported class action, class arbitration, or representative proceeding. You may only bring claims against us in your individual capacity.
13. Modifications to Terms & Entire Agreement
We reserve the right to modify these Terms at any time. Material changes will be communicated via website announcements or email notifications. Your continued use of the Service after the changes take effect constitutes your acceptance of the revised Terms. These Terms and the Privacy Policy constitute the entire agreement between you and us regarding the Service.
Part 2: End User License Agreement (EULA)
GoTraveli End User License Agreement (EULA)
Effective Date: April 21, 2026 Licensor (The Company): GoTraveli LLC (Wyoming, USA) Licensee (You / The User): The individual or entity downloading, installing, or using this Application
⚠️ IMPORTANT NOTICE - BINDING ARBITRATION AND CLASS ACTION WAIVER: To the fullest extent permitted by law, this Agreement contains a mandatory individual arbitration provision and a class action waiver. This means you agree to resolve any disputes with GoTraveli LLC through binding individual arbitration and expressly waive your right to litigate in court before a judge or jury, or to participate in any class action or representative proceeding.
1. Grant of License
GoTraveli LLC grants you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to download, install, and use the GoTraveli application (the "App") on a compatible device that you own or control, solely for your personal, non-commercial purposes. The App is licensed, not sold, to you. GoTraveli LLC reserves all rights, title, and interest (including all intellectual property rights) not expressly granted to you in this Agreement. [Apple & Google Compliance Acknowledgment]: You acknowledge that this Agreement is concluded solely between you and GoTraveli LLC, and not with Apple Inc. or Google LLC. GoTraveli LLC (and not Apple or Google) is solely responsible for the App and its content, maintenance, support services, and the investigation of any intellectual property infringement claims. Apple and Google have no obligation whatsoever to furnish any maintenance or support services with respect to the App.
2. Prohibited Conduct
To protect our services and the experience of all users, you agree that you will ABSOLUTELY NOT engage in any of the following activities:
- Reverse Engineering & Cracking: Decompile, disassemble, reverse engineer, or attempt to extract the source code, underlying algorithms, or data structures of the App.
- Malicious Attacks & Abuse: Use any robot, spider, crawler, or automated script to access the App; bypass, disable, or circumvent the App’s security features or Rate Limits; or use the App in any manner that could overload, disable, or degrade our servers or third-party APIs (such as Mapbox, OpenAI).
- Commercialization & Resale: Rent, lease, lend, sell, redistribute, or sublicense the App or any content generated by it (e.g., itineraries), or use the App to operate a service bureau or time-sharing service.
- Illegal Use: Use the App for any unlawful purpose or in violation of any local, state, national, or international law.
🚨 Legal Enforcement Right: If our system (or our automated circuit breaker mechanism) detects that you have violated any of the aforementioned prohibited conduct, GoTraveli LLC reserves the right to terminate your license immediately without prior notice, permanently ban your account, forfeit any paid subscription fees, and pursue full legal and financial damages against you.
3. User-Generated Content & Acceptable Use
[App Store Mandatory Requirement] The App may allow you to create, share, or post content (e.g., itinerary names, notes). You are solely responsible for all content you submit.
- Zero Tolerance Policy: GoTraveli maintains a Zero Tolerance policy for any content that is obscene, pornographic, violent, hate speech, harassing, discriminatory, or infringes upon the intellectual property rights of others.
- Content Moderation & Removal: We reserve the right (but have no obligation) to review, monitor, reject, or remove any user content that violates this EULA at any time, without providing any reason.
- Blacklist Mechanism: We reserve the right to permanently ban the device and account of any user who posts violating content or engages in harassment.
4. Core Feature Disclaimer & User Acknowledgment
The core functionalities of this App are driven by Artificial Intelligence (AI) and dynamic geolocation data. By using the App, you expressly acknowledge, understand, and agree to the following irrevocable disclaimers:
- AI Hallucinations & Content Inaccuracies: AI-generated travel recommendations, routing, location descriptions, time estimates, and budget approximations are generated based on probabilistic models. You acknowledge that this information is highly likely to contain fictional, outdated, contradictory, or completely erroneous content (i.e., "AI Hallucinations"). GoTraveli LLC makes absolutely no warranties regarding the accuracy, completeness, or suitability of any AI-generated output.
- User's Independent Verification Duty: The App is NOT an official travel agency or security consultant. Before taking any action based on an itinerary generated by the App (e.g., booking flights/hotels, traveling to specific locations), you bear the absolute obligation to independently verify all critical information, including but not limited to: visa and passport requirements, destination operating hours, real-time traffic conditions, weather warnings, and official travel safety advisories (such as consulate security notices).
- Unpredictability & Non-Uniqueness: You acknowledge that AI system responses are highly dynamic and non-deterministic. The system may provide completely different answers to the same or similar prompts at different times. GoTraveli does not guarantee the uniqueness of the generated results, nor does it guarantee compliance with any specific travel industry standards.
- Absolute Disclaimer (Personal & Property Safety): GoTraveli LLC assumes absolutely no legal or joint liability for any travel delays, financial loss, property damage, personal injury, or even death arising directly or indirectly from your credulity or reliance on any content generated by the App (including incorrect navigation routes, routing to dangerous neighborhoods, or missed flights/failed bookings due to outdated information).
5. Third-Party Services Dependency & Severability
The operation of the App is highly dependent on external third-party infrastructure and APIs (collectively, "Third-Party Services"). You agree that your use is concurrently subject to the respective End User License Agreements and Privacy Policies of these third-party providers. GoTraveli LLC explicitly severs itself from the failures and liabilities of the following Third-Party Services:
- Maps & Location Services (Mapbox / OSM, etc.): The map rendering, POI (Point of Interest) search, and routing features provided by the App rely on external providers like Mapbox. GoTraveli LLC assumes no responsibility for the accuracy of map data (e.g., incorrectly marked locations, missing roads, erroneous operating statuses). GoTraveli LLC is exempt from liability for any App feature degradation or unavailability caused by Mapbox API downtime or network interruptions.
- Generative AI Engines (OpenAI / Anthropic / Google, etc.): Itinerary generation relies on third-party Large Language Models. GoTraveli LLC shall not be liable for breach of contract if the App fails to generate content due to third-party API rate limiting, downtime, policy changes, or restricted model outputs.
- Payment & Subscription Gateways (Stripe / RevenueCat, etc.): All in-app purchases and credit card processing are handled by the Apple App Store, Google Play, or strictly PCI-DSS certified third-party gateways (such as Stripe). GoTraveli LLC's servers never touch, store, or process your raw payment data. GoTraveli LLC is absolutely not responsible for any financial loss caused by payment gateway failures, credit card fraud, or app store billing errors.
- Service Interruptions & Force Majeure: Third-party service providers may change their API rules, pricing structures, or discontinue services at any time. If GoTraveli must remove certain features or cease operations entirely due to third-party force majeure events, GoTraveli LLC bears no obligation to compensate you.
6. Subscriptions, Payments & Refunds
GoTraveli may offer premium subscription services (Pro Plan) via app stores or our official website. Your subscription and refunds are governed by the platform used for the purchase:
6.1 App Store Purchases (Apple App Store / Google Play) If you make an in-app purchase via the Apple App Store or Google Play:
- Your subscription will automatically renew unless you turn off auto-renew in your app store settings at least 24 hours before the end of the current period.
- All charges will be billed to your Apple or Google account.
- Refund Jurisdiction: All refund requests regarding in-app purchases are solely governed by the refund policies of the applicable app store (Apple or Google). GoTraveli LLC has no authority, nor the ability, to directly process, approve, or intervene in refunds generated through these platforms.
6.2 Official Website Purchases (Web Billing via Stripe)
If you purchase a subscription directly through our official website (gotraveli.com or related subdomains):
- Your payment will be securely processed by a PCI-DSS Level 1 certified third-party payment gateway (such as Stripe or RevenueCat Web Billing). GoTraveli LLC's servers never collect, store, or transmit your full credit card number.
- Your subscription will automatically renew based on your selected billing cycle (monthly or annually) until you actively cancel. You may cancel your subscription at any time before the end of the current billing cycle via your GoTraveli account settings page (or the Stripe Customer Portal).
- Cancellation & Refund Policy: Canceling a subscription prevents future automatic charges, and your Pro privileges will remain active until the end of the currently paid billing cycle. Except where mandatory laws require otherwise (e.g., the statutory "14-day cooling-off period" in certain EU countries/regions), all paid subscription fees are strictly Non-Refundable, and pro-rated refunds are not supported.
- Chargebacks & Malicious Refunds: If you initiate a fraudulent chargeback with your credit card issuer or Stripe, GoTraveli LLC reserves the right to immediately and permanently ban your account and submit the relevant transaction records to the payment gateway to dispute the chargeback.
7. Disclaimer of Warranties
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. GoTraveli LLC explicitly disclaims all warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We DO NOT WARRANT that the App will be uninterrupted, error-free, completely secure, or free of viruses or other harmful components. [Force Majeure & Travel Safety Statement]: The App does not provide security consulting. Users must refer to official travel advisories (e.g., from consulates). GoTraveli is not responsible for any itinerary losses caused by weather, strikes, political unrest, or force majeure events.
8. Limitation of Liability
Note: In certain jurisdictions, the law does not allow the exclusion of implied warranties or the limitation of certain damages. In such regions, our liability shall be limited to the maximum extent permitted by law.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GOTRAVELI LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES (INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA LOSS, OR TRAVEL INTERRUPTIONS) ARISING OUT OF YOUR USE OR INABILITY TO USE THE APP. IN NO EVENT SHALL GOTRAVELI LLC’S TOTAL CUMULATIVE LIABILITY TO YOU EXCEED THE GREATER OF THE AMOUNT ACTUALLY PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR FIFTY US DOLLARS ($50.00).
9. Governing Law & Dispute Resolution
This Agreement and any dispute arising out of it shall be governed by and construed in accordance with the laws of the State of Wyoming, USA, without regard to its conflict of law principles.
Any dispute that cannot be resolved through informal negotiations must be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) located in Cheyenne, Wyoming. YOU EXPRESSLY WAIVE YOUR RIGHT TO A TRIAL BY JURY.
[Statute of Limitations]: Any cause of action or claim arising out of or relating to this Agreement must be commenced within one (1) year after the cause of action accrues; otherwise, such cause of action or claim is permanently barred.
[Arbitration Opt-Out Right]: You have the right to opt-out of this mandatory arbitration provision by sending an email to legal@gotraveli.com within thirty (30) days of registering your account or first accepting this Agreement. If you do not send an opt-out notice within this timeframe, you are deemed to have fully accepted the arbitration and class action waiver provisions.
10. Export Control
You represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo or that has been designated as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties (such as the Treasury Department's Specially Designated Nationals (SDN) list). If you violate this representation, GoTraveli reserves the right to immediately terminate services to you.
11. Apple-Specific Terms & Third-Party Beneficiary
If you are using the App on an iOS device, the following additional terms apply:
- Warranty & Refund: In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.
- Product Claims: You acknowledge that GoTraveli LLC, not Apple, is responsible for addressing any claims relating to the App or your possession and/or use of the App, including, but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
- Third-Party Beneficiary: You and GoTraveli LLC acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this EULA, and that, upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.
12. Amendments
We reserve the right to modify this EULA at any time. If we make material changes, we will notify you via in-app notifications or email. Your continued use of the App after the changes become effective constitutes your acceptance of the revised EULA.
13. Feedback License
If you provide us with any comments, suggestions, bug reports, or feature improvement ideas regarding the App (collectively, "Feedback"), you agree that GoTraveli LLC may perpetually, irrevocably, without restriction, and without royalty, use, modify, and incorporate such Feedback without any obligation to compensate you or maintain confidentiality.

GoTraveli LLC ("we," "us," or "GoTraveli") respects the intellectual property rights of others and expects our users to do the same. As a technology platform providing intelligent travel planning and itinerary sharing services, this Policy establishes specific clauses tailored to the legal requirements of different jurisdictions. For all other countries/regions not explicitly listed globally, we will apply the "Notice and Takedown" mechanism of the US DMCA as our global default highest compliance baseline for handling infringement disputes.
1. Core Principles & Safe Harbor Statement
GoTraveli operates strictly as a technology-neutral Service Provider offering computing, storage, and route rendering capabilities.
When users utilize our services (especially by sharing itineraries via share.gotraveli.com), they may upload or publish text, photos, and other content ("User-Generated Content" or "UGC"). Our processing of user content is strictly automated, technical, and non-selective, and we do not engage in substantive editing or manual pre-screening of UGC. Users bear 100% legal responsibility for the UGC they submit. GoTraveli is legally protected by the "Safe Harbor" principle and assumes no direct, joint, or vicarious liability for infringing content uploaded by users.
2. Your Content & License to Us
When you create and share an itinerary on GoTraveli, you retain ownership of your original content. However, to enable us to provide the Service (e.g., generating sharing web pages, accelerating delivery via global CDNs), you must grant GoTraveli a worldwide, non-exclusive, royalty-free, sublicensable, and perpetual (solely for system backup purposes) license to store, distribute, modify (solely for technical adaptation purposes, such as thumbnail generation), render, and publicly display your content. ⚠️ Publicity Rights & Ownership Warranty: You represent and warrant that: you possess the full rights to all content uploaded to GoTraveli, that such content has secured all necessary Publicity Rights or personality rights, and that it absolutely will not infringe upon the copyrights, trademarks, or privacy rights of any third party.
3. Intellectual Property Boundaries for AI-Generated Content
GoTraveli integrates industry-leading generative AI models to assist with travel planning.
- Non-Exclusivity & Public Data: AI primarily generates routes by synthesizing public data points rather than copying specific protected works. Therefore, AI outputs may contain third-party indexed information. GoTraveli does not transfer any third-party intellectual property rights through AI-generated results.
- Declaration of Rights: GoTraveli does not claim exclusive copyright over plain-text outputs generated by AI; concurrently, you may not claim exclusive copyright over standard itinerary routes generated by GoTraveli’s AI, nor may you initiate infringement lawsuits against GoTraveli or other users based on such claims.
4. 🇺🇸 US & Global Default: DMCA Copyright Infringement Notice Procedure
If you are a US resident, or are initiating a copyright complaint regarding content within the US jurisdiction or any other unlisted global region, please submit a written notice to our Designated Copyright Agent at: legal@gotraveli.com.
The notice must include:
- A physical or electronic signature.
- The precise URL link(s) to the infringing content.
- Proof of the original copyrighted work.
- Your contact information.
- A statement of good faith belief and a statement under penalty of perjury.
GoTraveli reserves the right to ignore notices that do not substantially comply with the DMCA requirements.
🚨 Penalty for False Claims: The malicious submission of a false complaint constitutes a severe breach of contract. GoTraveli reserves the right to pursue legal action against the complainant and seek full compensation for all investigation costs and attorney's fees.
5. 🇪🇺 EU & 🇬🇧 UK Specific Copyright Regulation Clauses
Addressing the complex regulatory landscape in Europe, we have established the following dedicated procedures:
- 🇪🇺 European Union (EU) - Based on the Digital Services Act (DSA) & DSM Directive: If you are an EU resident or are complaining about content hosted within the EU, your "Notice and Action" request must not only meet the basic requirements of Section 4 but must also provide "Substantiated Explanations" clearly detailing why the content violates applicable laws. GoTraveli will prioritize reviewing your request through our internal complaint handling system and will lawfully send you an acknowledgment of receipt and a notification of the final decision. EU users have the right to receive an explanation of the reasoning behind any content removal decision.
- 🇬🇧 United Kingdom (UK) - Based on the Copyright, Designs and Patents Act 1988 (CDPA): For content subject to UK jurisdiction, we will follow the UK "Notice and Takedown" code of practice. Complainants must provide sufficiently clear proof of rights. UK notices must provide sufficient details to enable us to identify the location of the copyright material in a single communication. Upon receiving a valid notice constituting "Actual Knowledge," GoTraveli will act expeditiously to restrict access, thereby maintaining our platform immunity under the UK Electronic Commerce Regulations.
6. Counter-Notice Procedure & Victim Dispute Resolution Rights
If your shared itinerary link was removed due to a copyright complaint and you firmly believe it was not infringing (e.g., it qualifies as "Fair Use"), you may submit a Counter-Notice to legal@gotraveli.com. If it meets statutory requirements, we may restore the content within 10-14 business days, unless the original complainant has filed a lawsuit in court.
⚖️ Regional Dispute Resolution Rights:
- US & Global Users: Disputes will be subject to the mandatory binding arbitration clause within GoTraveli's Terms of Service (ToS).
- EU (DSA) & UK User Exclusive Rights: For users governed by EU or UK law, if you disagree with our content removal decision, in addition to submitting a Counter-Notice, you have the right to seek intervention from out-of-court dispute settlement bodies or directly file a lawsuit in a competent local court within your Member State/region.
7. Trademark Infringement & Other Abuses
If you believe that platform content infringes upon your valid registered trademark rights (creating a likelihood of confusion), please send proof of trademark registration and the allegedly infringing URLs to legal@gotraveli.com.
⚠️ Trademark Processing Isolation Principle: Trademark infringement complaints are not subject to the DMCA's 10-14 day automatic restoration rule. Trademark removal decisions will be based entirely on GoTraveli’s internal legal and commercial judgment, and we do not commit to providing an automatic restoration procedure for content suspected of trademark violations.
8. Repeat Infringer Policy
To maintain our Safe Harbor status, GoTraveli strictly enforces a "Repeat Infringer Termination Policy." For users who repeatedly infringe upon the intellectual property rights of others, we will unilaterally and permanently terminate their account access privileges without refunding any subscription fees. Declaration of Interpretation: GoTraveli retains the Sole and Absolute Discretion to define the criteria for "repeat infringement" (e.g., number of violations, severity).

Part 4: Refund Policy
GoTraveli Refund & Cancellation Policy

Thank you for choosing GoTraveli Pro. To protect your rights and clarify our subscription rules, please read this Refund & Cancellation Policy carefully before making a purchase. This Policy is an integral part of the GoTraveli Terms of Service (ToS).
1. General Policy & Jurisdiction
Given that the core services provided by GoTraveli (including AI itinerary planning and advanced map calculations) constitute instantly delivered digital SaaS products and services, your service is deemed actually delivered the moment your Pro subscription is activated or your Lifetime purchase is completed. Therefore, except as mandated by applicable law, all purchases made through our platform are considered final (All Sales Final), and in principle, we do not provide full or pro-rated refunds. Dispute Resolution: Any disputes regarding billing, auto-renewal, or refunds must be strictly resolved through individual arbitration in accordance with the "Binding Arbitration and Class Action Waiver" clause within the GoTraveli End User License Agreement (EULA).
2. Web Subscriptions via Stripe
For monthly or annual subscriptions purchased through the GoTraveli official website (using Stripe):
- Cancellation: To comply with laws such as the California Automatic Renewal Law (ARL), we provide an Easy-to-use and Online-only cancellation path. You may log into the GoTraveli website at any time, navigate to your "Account Settings" or "Billing Management" page, and actively cancel your auto-renewal with a single click. This action takes effect immediately.
- Post-Cancellation Rights: Canceling your subscription prevents future automatic charges. Fees already paid for the current billing cycle are non-refundable (no pro-rated refunds are provided), but you will continue to enjoy Pro-level premium features until the end of your currently paid cycle.
- Renewal Reminder: You are solely responsible for canceling your subscription at least 24 hours before the start of the next billing cycle. The Company assumes no refund liability for automatic charges resulting from your failure to cancel in time.
- Price Changes: We reserve the right to adjust subscription prices at any time. We will notify you of any changes to renewal prices at least 30 days in advance via email or in-app notification. If you do not agree to the new price, you must actively cancel your subscription before the change takes effect.
3. Mobile App Store Subscriptions (Apple App Store & Google Play)
For GoTraveli Pro subscriptions purchased via the Apple App Store or Google Play:
- Refund Jurisdiction & Assistance: All billing, auto-renewal, and refund requests are strictly governed by the official platform policies of Apple and Google. While we are highly willing to assist in resolving your issues, due to Apple's system architecture and privacy restrictions, only Apple has the sole authority to directly process and approve refunds. We will guide you to submit your refund request directly to Apple via
reportaproblem.apple.com. - How to Cancel: If you need to cancel your auto-renewal, you must do so directly through your device's system settings (iOS: Apple ID Settings -> Subscriptions; Android: Google Play Subscription Center). We do not have the authorization to cancel third-party platform subscriptions for you from our servers.
4. Lifetime Plan Special Note
The Lifetime Plan is a one-time payment. Once the purchase is confirmed and account privileges are unlocked, the digital content is deemed fully delivered, and refunds are not supported for any reason.
5. EU/UK Right of Withdrawal Waiver
This clause is specifically designed to comply with the EU Consumer Rights Directive and relevant UK laws: Under normal circumstances, consumers in the EU and UK enjoy a 14-day "right of withdrawal" without providing any reason when purchasing digital products online. HOWEVER, when you click to purchase and immediately unlock Pro features on GoTraveli, it signifies that you expressly consent to our immediate commencement of digital content delivery, and hereby explicitly acknowledge that you thereby waive your 14-day statutory right of withdrawal.
6. Account Violations & Abuse Prevention
- Violation Bans: If your account is restricted or permanently banned by us for violating the Terms of Service (e.g., malicious abuse of API quotas, engaging in illegal activities, or automated scraping), you will have no right to receive a refund for any remaining subscription time.
- Abusive Subscription Testing: GoTraveli reserves the right to investigate and restrict services for abnormal accounts that frequently subscribe and immediately cancel within 24 hours in an attempt to "freeload" Pro privileges.
- Malicious Chargebacks: If you initiate a fraudulent chargeback directly with your credit card issuer or Stripe without prior communication with us, we will submit your account usage logs, IP records, and this Refund Policy to the financial institution as defense evidence, and we reserve the right to immediately and permanently ban your account.
7. Technical Failures & Ex-gratia Refunds
- Definition of Technical Failure: The refund exception (technical failure) described in this policy solely refers to a "major system paralysis resulting in the complete unavailability of GoTraveli's core functionalities for more than 72 continuous hours." This definition explicitly excludes temporary service degradation caused by poor local networks, device compatibility issues, or third-party API providers (e.g., OpenAI downtime, Mapbox rate limiting).
- Exceptions & Discretion: In extremely rare circumstances, GoTraveli LLC holds the sole and absolute discretion to determine whether to provide you with a one-time Ex-gratia Refund based on the actual situation. Such compensatory actions, taken to maintain brand reputation, shall absolutely not constitute a legal waiver of this "no refund policy" for future or other cases.
